Startorent Terms of Use
1. Introduction
Welcome to Startorent, a peer-to-peer rental platform that connects users looking to rent or lease tools, equipment, and materials. By using our platform, you agree to abide by these Terms of Use. Please review these terms carefully as they set out your rights and obligations.
2. User Responsibilities
a) Accurate Information
Users are required to provide accurate, complete, and up-to-date information about themselves and the items they list. This includes item descriptions, conditions, and compliance with local regulations (such as CE-marking for applicable tools).
b) Legal Rights
Users must ensure that they are the rightful owners or legally authorized to rent out the items listed. Any illegal activity, such as listing stolen goods or counterfeit items, is strictly prohibited.
c) Item Safety & Condition
It is the userβs sole responsibility to ensure the rented items are safe and functional. Users must verify that the items comply with all local safety regulations and provide necessary usage instructions to renters. Users are also responsible for maintenance and must repair or replace defective items before listing them.
d) Insurance β No Coverage Provided by StartoRent
StartoRent does not provide any insurance coverage for items listed or rented through the platform.
As a listing owner, you are solely responsible for ensuring your items are adequately insured against damage, theft, or loss during a rental. As a renter, you are responsible for having liability insurance that covers damage to rented items during use.
We strongly recommend all users:
- Contact their insurance provider to verify coverage for peer-to-peer rental activities
- Consider specialized rental insurance for high-value or specialized equipment
- Review their home/contents insurance policy for third-party liability coverage
- Ensure professional users have adequate commercial liability insurance
By listing an item, you confirm that you accept full liability and have adequate insurance or knowingly assume the risk. By renting an item, you acknowledge that StartoRent does not insure the transaction.
3. Platform's Role
a) Facilitator Only
Startorent provides a platform to connect users but does not directly participate in the rental transactions. Startorent is not responsible for the quality, legality, or safety of the items listed, nor does it guarantee the accuracy of any information provided by users.
b) No Warranty
Startorent makes no warranties regarding the items rented through the platform. The platform is provided 'as is,' and any issues regarding the condition or functionality of rented items must be resolved between users.
c) Limitation of Liability
Startorent is not liable for any damages, direct or indirect, arising from the rental of items between users. This includes personal injury, property damage, or financial losses. Users agree to release Startorent from any liability related to their use of the platform.
d) Identity Verification
StartoRent offers an optional identity verification system where users can submit a valid identity document (National ID Card, Passport, or Driving License) to confirm their identity.
This verification is for identity confirmation only and does not constitute:
- Confirmation of driving competency or authorization to operate any vehicle or equipment
- Proof of insurance coverage
- A guarantee of the user's suitability to use any specific item
- A full legal or administrative identity check
Users remain solely responsible for complying with all applicable legal requirements, including but not limited to holding valid driving licenses, meeting usage conditions, and maintaining appropriate insurance coverage.
Identity documents are permanently deleted from our servers immediately after review. Only the verification status and basic metadata (document type, country of issue) are retained.
4. Rental Transactions
a) Agreements Between Users
All rental agreements and payments are made directly between users. Startorent provides tools for users to communicate and make transactions but does not act as a party to these transactions.
b) Payments
Startorent facilitates payments through Stripe, a third-party payment processor. Users are required to provide accurate payment information, and Startorent does not store or manage credit card information. Payments are processed securely, and funds are typically transferred to the seller within 24-48 hours after the transaction is confirmed.
c) Service Fees
Startorent charges a service fee of 5% on all transactions. This fee supports platform maintenance, customer support, and security measures. All service fees are clearly displayed during the transaction process, and there are no hidden fees for users.
5. Item Listing and Prohibited Items
a) Listing Standards
Users are responsible for ensuring that all listed items comply with local laws and safety regulations. Items that pose a risk to health or safety should not be listed without proper safety certifications.
b) Prohibited Items
The following items are prohibited from being listed on Startorent:
- Weapons and firearms
- Illegal substances and drugs
- Hazardous chemicals or materials
- Live animals
- Stolen or counterfeit goods
- Any item that violates local, national, or international laws
6. Cancellation and Dispute Resolution
a) Cancellations
Users may cancel a rental transaction before it is confirmed. Once confirmed, cancellations may incur penalties as outlined by the terms of the rental agreement between users. Users are encouraged to discuss cancellation terms before completing a transaction.
b) Dispute Resolution Between Users
Startorent recommends that users resolve disputes amicably through direct communication. If an issue arises that cannot be resolved, users can contact Startorent for assistance in enforcing platform rules, but Startorent will not mediate disputes beyond platform-related issues.
c) Platform-Related Disputes
In the event of a platform-related issue, users may contact Startorent customer support. Startorent reserves the right to review and investigate any claims of violation of these Terms of Use and may suspend or terminate user accounts at its discretion.
7. Country-Specific Clauses (Netherlands, Belgium, France, Germany)
a) Fiscal Obligations & Income Declaration
Rental income earned through StartoRent may be taxable. Users are solely responsible for declaring their earnings and complying with the tax laws of their country of residence.
Tax rules for rental income differ per country. Depending on your country, rental income may be subject to income tax, VAT, social contributions, or other levies. Specific thresholds and tax regimes may apply.
StartoRent does not provide tax advice. We strongly recommend that all users consult a qualified tax advisor or their local tax authority for guidance on their specific obligations.

b) Platform Reporting (DAC7)
StartoRent is subject to the EU DAC7 directive (Council Directive 2021/514), which requires digital platforms to collect and report seller information and transaction data to national tax authorities.
When legally required, StartoRent will report user data including name, address, tax identification number, gross income, and transaction count to the relevant tax authority. By using StartoRent, you consent to this data collection and reporting as required by law.
c) Local Consumer Protection Laws
Each country within the EU has specific consumer protection laws that users must adhere to. Users should familiarize themselves with the rental, sales, and consumer rights laws applicable to their country of operation.
d) Rental and Safety Regulations
Users must ensure that any rented equipment complies with the safety standards of their respective country. For example, tools and machinery rented in the Netherlands, Belgium, France, or Germany must have the appropriate CE-marking or other safety certifications.
8. Account Suspension and Termination
Startorent reserves the right to suspend or terminate user accounts that violate these Terms of Use, including fraudulent activity, failure to meet safety standards, or listing prohibited items. Startorent may also take legal action against users who engage in unlawful conduct on the platform.
9. Modifications to Terms of Use
Startorent reserves the right to modify these Terms of Use at any time. Users will be notified of any changes, and continued use of the platform constitutes acceptance of the revised terms.
10. Governing Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with the laws of the European Union and the local laws of the user's country of residence. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in the user's country.
